ISLAMABAD – The special parliamentary committee on the 26th constitutional amendment reached an agreement on the formation of a constitutional bench during a meeting.

The special parliamentary committee meeting, chaired by Syed Khursheed Shah, was held where the government presented its draft for the constitutional amendment.

The government’s draft presented in the special parliamentary committee does not mention a constitutional court. Instead, it proposes the formation of a constitutional bench, and no party, including PTI, objects to this.

The government has backed away from establishing a constitutional court. The judicial commission will handle the appointments to the constitutional bench. The draft also proposes reconstituting the judicial commission.

In matters regarding the appointment of the Chief Justice, the draft suggests appointing one of the three senior judges. The parliamentary committee will propose the names of the three senior judges.

Changes in the structure of the parliamentary committee, which will send its recommendations to the prime minister. After the president’s approval, they will be notified. The draft proposes including six judges in the formation of the judicial commission.

Additionally, the commission would include the Law Minister, Attorney General, a retired Supreme Court judge, some lawyers, an MNA, and a senator.

Sources further state that PTI has reservations regarding the proposal to allow dual citizens to resign after 90 days. JUI-F emphasizes that the Chief Justice should be appointed based on seniority, and only afterward should the matter of three judges be considered.

The special parliamentary committee will reconvene tomorrow at 12:30 PM.
