PESHAWAR – The Peshawar High Court exercising its powers has suspended a district and session judge from Kohat, who had moved the Supreme Judicial Council on Tuesday against the alleged misconduct of Chief Justice of Pakistan Mian Saqib Nisar.
According to notifications issued by the PHC on Wednesday, Tareen was not only transferred as an officer on special duty (OSD) but also suspended immediately in ‘public interest’.
One of the notifications says, “Honourable the Chief Justice and Judge of this Court are pleased to order immediate transfer of Mr. Ahmed Sultan Tareen, District & Session Judge, Kohat transferred and post him as OSD Peshawar High Court, Peshawar in the public interest, He stands relieved and directed to report to this office immediately”.
The other notification says that the high court suspended Tareen exercising power conferred by Rule 6 of the Khyber Pakhtunkhwa Government Servants (Efficiency & Discipline) Rules, 2011.
The suspended judge in his complaint said that the chief justice lacked qualities, which have been described in Article-II of the Code of Conduct issued by the SJC in 2009.
The complainant also said: “If he had no political ambitions, he, instead of desiring things for the people of Pakistan, which are not his domain to ensure, should have thought about the failing of judicial system mainly due to ineffectiveness of the courts in providing justice in context of Article 10-A read with clause (d) of Article 37 of the Constitution of Pakistan.”
He also showed reservations over the recent meeting between CJP Saqib Nisar and Prime Minister Shahid Khaqan Abbasi, saying the CJP did not disclose the agenda of the meeting. The complainant added that not disclosing the agenda was against basic rights of citizens.
