High Stakes Legal Showdown As Supreme Court Takes Up Article 63 A Election Issues Today

ISLAMABAD – Supreme Court of Pakistan is all set to take up high-profile cases including a review petition challenging apex court’s interpretation of Article 63-A of the Constitution, which pertains to the disqualification of parliament members.

Chief Justice Qazi Faez Isa will spearhead five member bench to review its reserved judgment regarding election tribunals in Punjab province. This follows a decision previously scheduled for September 23rd, focusing on the legal interpretation of parliamentary disqualification.

The country’s top court has also released its roster of judges for the upcoming week, with seven benches assigned to hear various cases at the Principal Seat in capital.

Sep 30 agenda will also feature discussions on pensions for retired High Court judges, alongside a recount petition for NA-37 Kurram set for Thursday.

The court’s earlier ruling on May 17, 2022, regarding Article 63-A determined that votes cast by defected parliament members against party policy would be disregarded, with the duration of disqualification to be defined by parliament. This ruling was split 3-2, with dissent from Justices Mazhar Alam Miankhel and Jamal Khan Mandokhail. The majority opinion by Justice Munib Akhtar has led to multiple pending review petitions.

As the hearings unfold, the legal community and the public will be closely watching for implications that could reshape political accountability in Pakistan.
