ISLAMABAD – Pakistan’s foreign office has said the International Court of Justice does not have jurisdiction to stay Indian spy Kalbhusan Jadhav’s execution, who was sentenced to death by a military court earlier this year.
“This is a matter of national security. Pakistan does not accept the ICJ’s jurisdiction in the case of Indian spy Kalbsuhan Jhadav,” Foreign Office spokesperson Nafees Zakaria stated during weekly news briefing in Islamabad.
He added that Jhadav confessed to his crimes twice.
Earlier on Thursday, the UN’s top court announced its ruling on an urgent bid by India to stop Pakistan from executing a death sentence for Jadhav, one of its nationals convicted of spying and subversive activities in Pakistan.

Rejecting Pakistan’s argument that the court did not have jurisdiction in the matter, the court reasoned it could hear the case because it involved, on the face of it, an alleged violation of one of the clauses of the Vienna Convention, which both Pakistan and India ascribe to.
“[Meanwhile] Pakistan should take all measures to ensure that Mr Jadhav is not executed till the final decision of this court,” the court said.
The court also said Pakistan should inform it of all measures taken in implementation of the order.
The president of the court, Ronny Abraham, read out the decision.
According to the FO spokesman, Pakistan also seeks access to Jhadav’s contacts in India. “Our (Pakistani) lawyers took the same stance in the ICJ but India has not given a positive reply,” he added.

Kulbhushan Jadhav
Jadhav, still a serving officer in the Indian Navy who is due for retirement in 2022, was arrested from Balochistan on March 3, 2017.
He was the contact man for Anil Kumar Gupta, the joint secretary of India’s premier spy agency RAW, and his other operatives in Pakistan.
Jhadav started carrying out intelligence based operations in 2002 and in 2003 established a small business in Chabahar, Iran. He was tasked with disrupting development of CPEC, with Gwadar port as a special target.
Jadhav directed various activities in Karachi and Balochistan at the behest of RAW.
India’s nuclear madness
Responding to latest reports that India has material to prepare 2,600 nuclear weapons, the spokesperson was quoted by Radio Pakistan as saying, “Pakistan has been underscoring the risk of diversion by India to imported nuclear fuel, equipment and technology received pursuant to civil nuclear accord and 2008 energy waiver by Nuclear Suppliers Group”.
He also asked NSG members to take up the risks involved in transfer of nuclear material to India and its NSG membership bid.
Talking about occupied Kashmir, the spokesperson said Hindu terrorist group, RSS, has been making its place to carry out its activists and establishing its units in Occupied Kashmir. RSS had killed more than half a million Kashmiri Muslims in November 1947 together with Dogra and Indian occupation forces. The increasing involvement of RSS in Kashmir is to bar people from self-determination movement.
The spokesperson said Advisor Foreign Affairs has written a letter to the UN inviting its attention towards demographic changes being developed by India in Occupied Kashmir in violation of UN Security Council resolutions.
