Govt can’t remove Justice Qazi Faez Isa, affirms CJP Khosa

LONDON – The Chief Justice of Pakistan (CJP) Asif Saeed Khosa has clarified that the government could not remove Supreme Court’s Justice Qazi Faez Isa and the Supreme Judicial Council (SJC) would deal with the matter fairly.

“Trust the judges. They will ensure justice [in the matter],” the chief justice said on Sunday in an informal conversation at the Cambridge University.

The top judge said he could not comment further on the matter as it had to be scrutinized by the council.

The chief justice dished in on multiple matters saying, the model courts had proven to be promising for the quick provision of justice; the top judge said whether it was martial law or a democratic system in the country, the judiciary had been constantly striving for the rule of law.

The judge observed that if the system is not fully functional in ensuring justice, the judiciary was not responsible for that.

The CJP said while sentencing accused, judges needed to keep in view the circumstances and the family of the accused as justice demands that all circumstances are taken into account.

Justice Isa is facing a reference filed by the government with the SJC over charges of misconduct, however, the judge denies the charges.

The Supreme Judicial Council would conduct the hearing on June 14; the body is headed by the chief justice.
