Court authorised to review unconstitutional acts of any institution: CJP Saqib Nisar

ISLAMABAD – Chief Justice of Pakistan Justice Saqib Nisar on Monday said that court has right to review the acts of any institution and authority on violating the Constitution.

The Chief Justice stated this while addressing full court reference on the beginning of the new judicial year at Courtroom No 1 of the Supreme Court. He added that supremacy of law should be maintained as injustice caused of unrest and anarchy.

He directed all organs of the state to follow the Constitution in letter and spirit to ensure the rule of law.

“Judiciary provides justice according to law and constitution,” he said, adding that it also ensured protection of basic rights.

On the event, the Chief Justice urged the judges to be independent from any kind of influence while running the court matters.

“We serve the people of Pakistan and we serve the Constitution of Pakistan to the best of our understanding and ability. We do not write judgments to please, we do not write judgments to settle scores, we render judgments in the fine scales of justice,” Express Tribune quoted Justice Nisar.

He further highlighted that 29,657 cases were settled under human rights cell.

The new Judicial Year 2017-18 in the apex court is going to start from today (September 11) amid many challenges of accountability and the backlog of cases.

Speaking on the occasion, Attorney General Ashtar Ausaf said that the Constitution set limits for judiciary, administration and parliament.

Political cases were brought to court where parties were deprived of their right to appeal, he said, apparently hinting at Panama Papers case verdict in which former prime minister Nawaz Sharif had been disqualified for not being honest.

He further added that investors have to pay billions of rupees as penalty due to judgments passed by the courts.

The ceremony was attended by law officers of the Supreme Court, officials of Law and Justice Commission of Pakistan and the lawyers.
