IHC halts construction of commercial builidings in Banigala

ISLAMABAD – The Islamabad High Court (IHC) has imposed a ban on all kinds of construction activities in Banigala suburb located near Rawal Lake in Islamabad.

A larger bench comprising Justices Athar Minallah, Aamer Farooq and Mohsin Akhtar Kayani heared a petition filed by Shahazada Sikandarul Mulk seeking a ban on the construction of the commercial building on a busy road in Banigala, Dawn news reported.

The petitioner took the stance that constructing commercial buildings would damage the environment of the area.

Counsel for Capital Development Authority (CDA) told the court that the property owned by the petitioner is not legal, because of its unapproved building layout plan.

Responding to the point, the owner of the building highlighted identical construction in the area, and subsequently the court banned all construction activity.

In detailed comments filed by CDA’s counsel before the bench, he informed the court about measures taken by the authority to save the environment of the area in question.

The IHC will hear the case again on May 18. The court has also directed the CDA to enforce its bylaws in Banigala.
