ISLAMABAD — Supreme Court released comprehensive verdict, upholding Pakistan Tehreek-e-Insaf’s political status as a parliamentary party eligible for reserved seats for women and minorities.

The case was deliberated by a 13-member bench, led by Chief Justice Qazi Faez Isa, and 70-page judgment, authored by Justice Shah, highlights impact of electoral authorities unlawfully denying recognition to a major political party, emphasizing that such actions compromise candidates’ rights and undermine electoral legitimacy.

The court stressed the vital role of free and fair elections in democracy, asserting that the judiciary must safeguard electoral integrity to maintain public trust. It noted that the court’s ability to deliver “complete justice” is crucial in preventing democratic backsliding.

The ruling also raised questions about ECP’s authority to reject intra-party election certificates and expressed concerns over the potential prioritization of internal party governance over citizens’ voting rights.

As the court refrained from definitive judgments on these matters, it acknowledged that they are currently under review in a separate petition filed by PTI concerning a prior ruling that denied the party its symbol. Justice Mazhar clarified that his statements would not affect ongoing proceedings.

The verdict pointed to numerous unlawful actions by Returning Officers and the Commission, which have caused significant confusion and prejudice to PTI, its candidates, and voters.

The court stressed the case’s importance and determined that decisions should be based on concrete evidence rather than assumptions. It stated that rights of voters must be supported by written declarations from elected candidates and confirmations from the Pakistan Tehreek-e-Insaf (PTI).

The apex court ruling highlighted Election Commission of Pakistan (ECP) as a key guarantor institution of democracy, not just an administrative body.

The verdict, decided by an 8-5 majority, is said to be a blow for ruling coalition, who are already facing issues.
